Your Agreement with Ed-Tech Solutions LLC ("Company" or "we" or "us", "our"): A Guide to Using Classwatch360 and our Services

Hello and welcome! This document outlines the terms and conditions that govern your access and use of the Classwatch360 platform. This includes everything from the website itself to the blog, downloadable or installable apps for your computer or tablet, and all other features and services we provide (referred to collectively as the "Platform").

Whether you're just browsing our website or a user ("User"), accessing or using our Platform indicates your acceptance of these Terms of Use ("Agreement"). This Agreement also incorporates our Privacy Policy, creating a single, unified understanding. By using Classwatch360, you agree to comply with these terms and all applicable laws within New Jersey and the United States.

Understanding Platform Usage

Our Platform is designed for individuals aged 18 and older. If you're using the Classwatch360 platform anywhere, you confirm that you are at least 18 years of age. The Platform should not be used for gaining an unfair edge in the industry or for any commercial exploitation. Services and products are intended exclusively for those legally able to enter into binding agreements.

Data submitted by you and fellow users ("User Submissions"), including opinions, images, links, text, music, videos, graphics, files, ideas, and data, represents your individual or organizations perspectives and is not endorsed by Classwatch360. You are fully accountable for your own postings and what you enter/update into the Platform.

Subscription Plans and Fees

Users will adhere to all fees. Providing the details for payments signals authorization for Classwatch360 to withdraw service costs, taxes and fees, and other extra expenses. The payment method is assessed for product costs that may be on a regular cycle. These service intervals are automatic as according to the chosen subscription plan. Payment costs also include failure to process payments from the past, and additional fees.

Code of Conduct

To use the Website and Classwatch360 platform, users must obey the rules of conduct that comply with standards. User Submissions must not be posted if they feature illegal, libelous, inaccurate, harmful, sexually explicit, malicious, offensive, obscene, or violent content. User submissions are required to respect personal rights. In accordance, privacy, contractual, property, and proprietary rights are important for User Submissions. Any advertisements are prohibited, and users must not impersonate other users. In sending messages or using service, sending unsolicited content is prohibited and users must not engage in content retrievals.

Company makes zero guarantees to actively watch User Submissions on our website or on the data entered/updated into ClassWatch360 Platform and is not liable for any false, inaccurate, unlawful, or questionable posting.

Any harmful activity is fully disclaimed by Company. At its discretion, Company holds the right to terminate accounts, remove content, modify content, edit user accounts, terminate user accounts, terminate user access, and restrict access to service. This also includes user accounts that harass Company service providers. If an action must be made, you can contact Company to handle it, however we can never make guarantees for this.

Informational Accuracy

Updates are made periodically to the Site, however we cannot provide the guarantee for it to be error-free or complete. We may make change this without prior notice or reason. Apologies for the inconvenience, but the team can, at any time, make the necessary corrections to Site. This can be done during the stages of a transaction, which can result in refused access, corrections, and a revised final payment. All prices have set time limits and change without Company providing notice.

The site will be priced according to revenue and service provisions. If these exceed the cost to provision, then service may be revised, changed, and refused.

Account Termination

All access, submissions, and parts of Site can be terminated with a User account by the service at our own discretion. Notice is not required nor is there anyone who can be held responsible. The terms are applicable for anyone accessing the Platform, accessing or subscribing on the site, such as User. Also, terms surrounding warranty disclaimers, limitations, indemnity, governing law, and copyrights can survive use of site.

Financial Protection

All affiliates and service staff are required to protect, defend, and secure Company when damages, or losses arise due to agreements with the Site, third party rights, laws, policy, data agreement, and related activity.

Ownership, Copyright, and Trademarks

The Classwatch360 name, content, and graphics are all part of trademark, law, applicable rights, and intellectual property that are owned by Company. There are also third-party trademarks, products, and logos of others that we cannot manage. It is Company who is authorized to change, duplicate, copy, produce, and utilize trademarks. All users must respect all existing Site rules and not apply anything on new Site features if that is deemed in violation.

Liability Exclusions and Warranty Denials

Company provides the site and Classwatch360 “as is” and does not claim to make any warranties, express or implied, about the serviceability, merchantability, fitness for a particular purpose, or content of the site. Company further does not warrant that its site or applicable server is free from viruses or other potentially harmful code. Neither Company nor any of its service providers shall be liable for any claims arising from any use or inability to use products or services, privacy law violations, data breaches, the conduct of other site users, malfunctions or defects in the site, lack of privacy or security when using the site, for any delay in or lack of delivery, for any loss of profits, data, or business, for user or any third party, as permissible under all applicable law. If applicable law does not permit such an exclusion of liability for incidental, special, or consequential damages, Company's liability shall be limited to the maximum extent permitted by applicable law. 

 

User agrees to indemnify and hold harmless Company and its service providers from damages, and neither party will be liable for any indirect, incidental, special, consequential or any damages whatsoever (including, but not limited to, damage caused by lost profits, loss of business opportunity, lost data, computer viruses, business interruption, lost revenue, or loss of goodwill) for any cause of action, whether in contract, tort, strict liability, or otherwise, arising out of or related to this agreement or a breach thereof. In no event shall Company be liable for damages in excess of the price charged to user for user's order. This limitation shall not apply to death or personal injury to the extent that applicable law prohibits such limitation. Company reserves the right to change or discontinue at any time any aspect or feature of this site.

 

Privacy

Our Site and Classwatch360 Platform does not comply with the rules for HIPAA. The laws for HIPAA, HITECH, and data protection are solely handled by User and responsibility is never ours.

 

When GDPR is in use and applies to Site, data information is contained and referred to in data agreement. This replaces all those agreements that were made in accordance with any previous terms, namely EU Directive 95/46/EC.

Our company has an understanding to protect any Personnel Data. The consent from personnel of User’s affiliates and third parties is a requirement. Protections may have varied scope according to the Privacy Policy, which includes access, protection, protection, handling, and all transfers outside a domicile. These terms are in place to be followed by User and Personnel.

In adherence to the agreement, (1) GDPR means a General Data Protection Regulation, and (2) the Personal Data is the information that connects to natural entities with identification to provide the Site.

​

Laws of Governance

We manage and monitor our Site in Middlesex County Of New Jersey. Because of this, it is hard to prove that the services in here are usable for outside locations. Users must use this site under terms of Policy, agreement, and DPA.
